Frequently Asked Questions
Am I required to appear at court on the date stated on my citation?
Your citation will indicate if you must appear.
If there is an “x” or checkmark in front of “yes” after "appearance required" on a traffic citation or in the box in front of “yes” after “is this a mandatory appearance?” on a municipal ordinance citation, you must attend the court session on the date and time indicated on the citation.

What if my appearance is marked mandatory/required but I reside a considerable distance from Baldwin, preventing me from appearing in person?
If you reside more than 50 miles from Baldwin, you may request an Appearance by Phone…
- No later than the Wednesday before your assigned court date, call the Clerk of Court (715.684.4930) to provide your telephone number.
- Prior to the court date, the Clerk of Court will contact you to provide an estimated time of your call.
- On the date of your court session, the Clerk of Court will call you to announce your appearance to the Judge.

What if I fail to appear for a mandatory initial appearance?
If you fail to appear for a mandatory initial appearance, the judge has the option to issue a bench warrant for your immediate arrest for appearance at court or issue a warrant for your arrest for commitment to the county jail.

If my appearance is not marked as required/mandatory, what are my options?
1. You may attend the initial appearance court session, as scheduled.
2. Prior to your court date, you may complete and submit a Plea by Mail.
3. You may submit your forfeiture payment prior to the court date stated on your citation. A "plea of no contest" and "finding of guilt by default" will be entered to the violation; if you have paid your forfeiture in full, the case will be concluded.
4. If you do not appear at the initial appearance session, a "plea of no contest" and "finding of guilt by default" will be entered to the violation. You will then be required, by a court ordered summons, to appear at a "good cause" hearing session or pay your forfeiture in full by the date of the court session stated in the summons.

What is the purpose of an initial appearance?
The initial appearance session of the court is primarily for the purpose of entering your plea to the alleged violation of the law.

What can I expect at the initial appearance court session?
Upon arrival, the Clerk of Court will provide you with a defendant information form to complete and an outline of the court procedures. Just prior to the judge entering the court room, you will be reminded to remove your hat/cap and shut off/silence your phone and other electronic equipment. Please remain quiet while the court is in session; give others the courtesy to be heard and present their case. You will rise when the judge enters the court room and wait for your case to be called.

What happens when the judge announces my name?
When your name is called, come forward promptly to the podium, facing the judge. The charge against you will be read and the judge will request that you enter your plea of guilty, no contest or not guilty.
Note: If this is your first scheduled appearance date, you have the right to request a continuance. The continuance can be used to consult with an attorney.

What is a guilty plea?
If you enter a plea of guilty, you are admitting to the charges against you. You will be found guilty of the charges and a penalty/sentence will be imposed.

What is a plea of no contest?
If you enter a plea of no contest, you are neither pleading guilty nor not guilty, but merely want to have the matter resolved and pay the penalty. The effect of this plea is that you will be found guilty but will not be admitting your civil liability for use in other litigation, which should be expected where personal injury or property damage is involved.

After I enter a plea of guilty or no contest, what is the result of a finding of guilty?
If you are convicted, you will be given the opportunity to make a statement regarding your citation. The judge will then examine your conviction record and set the penalties.

Must I pay the penalties at the court session?
If you cannot pay in full at the court session, the judge may grant you a reasonable length of time to pay your forfeiture. The judge may request your input regarding your ability to pay within a set number of days or it may be that a monthly payment plan is ordered until the forfeiture is paid in full. You will also be instructed that if you fail to pay within that time period agreed upon, the court will set an alternative penalty of imprisonment in jail or suspension of your driving privileges (license.)

What happens if I enter a plea of not guilty?
If you enter a plea of not guilty, you deny committing the offense and the matter will be adjourned to a later court date. The Court will have you complete a "Plea of Not Guilty" form and a pre-trial will be scheduled. (Please note: When you end a plea of not guilty, the Judge cannot discuss the details of your charges. The Judge is obligated to refrain from discussing your violation in the event you appear for this court for a trial).

What is a pre-trial hearing?
If you entered a plea of not guilty, you will be scheduled for a mandatory meeting to discuss a possible settlement with the prosecutor for the Village of Baldwin. The judge does not participate in the pre-trial hearing nor does he/she have to accept any negotiated or amended charges.

What happens if there is no settlement at the pre-trial hearing?
If there is no resolution to your case during the pre-trial hearing, a court trial will be scheduled. All trials, except non-traffic juvenile cases, are public trials.

What is the procedure at a court trial?
You have the right to retain your own attorney and to subpoena witnesses. You are presumed innocent and will be convicted only if evidence is clear, convincing and satisfactory that you committed the violation with which you have been charged. All witnesses must testify in person and under oath.
The prosecution will produce its witnesses to testify as to the facts and circumstances surrounding your alleged violation. You or your lawyer will be permitted to cross-examine each witness that testifies. When the prosecution has completed its case, you and your witnesses will be given the opportunity to testify and you will be cross-examined by the prosecution.
The Rules of Civil Procedure and Evidence will be followed.
After all the evidence has been presented, the prosecution and the defense will be given an opportunity to summarize, by brief argument, their respective case to the court. The court will decide whether to find you guilty or not guilty based on 1) the evidence 2) the testimony and 3) the law.

What if I fail to appear for a pre-trial hearing or court trial?
If you fail to appear at your scheduled pre-trial or the court trial, the court will either enter a default judgment against you or issue a warrant for immediate arrest.

What is an indigency/good cause hearing?
If the court sends you notice requiring your appearance at an indigency/good cause hearing, you will appear before the judge to show cause that you are unable to pay the forfeiture for good cause or because of your indigence.
Complete the Municipal Court Indigency Evaluation Form and bring it, along with supporting documentation, to your scheduled court session.
You do not need to appear if your forfeiture is paid in full by the date of the hearing.

What happens if I don't pay the court ordered forfeiture or appear at a good cause hearing?
There may be serious consequences if you fail to pay the forfeiture or appear as ordered in a summons. The court may take one or more of the following actions:
1) Suspension of your driving privileges for up to two years
2) Enter your debt into the Wisconsin Debt Collection (SDC) Program
3) Issue an order for your incarceration in the county jail for not more than 90 days or until the forfeiture is paid in full

What if the citation is issued to a juvenile?
The court has jurisdiction over persons between the ages of twelve (12) and eighteen (18) charged with non-traffic ordinance violations. Juveniles have the same rights as adults with respect to pleas.
It is required that a parent or legal guardian accompany the juvenile to all hearings. Juveniles have the right to a closed hearing but may waive this right.
The court has discretion over any persons wishing to remain in the court room for the proceedings. Victims of a juvenile act have the right to be present for all hearings.
A monetary judgment may be entered against a juvenile if found guilty.

What if the address on my citation is wrong or I move?
If you have any pending cases with the Baldwin Municipal Court, it is important to notify the court of your new mailing address or to correct an address on a citation.
It is your responsibility to provide the court with appropriate contact information so you receive proper notifications regarding your case.

If the court orders a suspension of my driving privileges, how do I reinstate my license?
If your driver’s license is suspended or revoked for any reason, in addition to paying your court ordered forfeiture, you must also pay a reinstatement fee to the WI Department of Transportation.

What is the Wisconsin Debt Collection (SDC) Program?
The Wisconsin Department of Revenue has been granted authority to act as the collection agency for debts owed to state, county and local government agencies. If you do not pay the forfeiture and fines for your citation, the Baldwin Municipal Court may forward your debt for collection, including delinquent collection fees.

How do I contest a parking ticket?
To contest a parking ticket, contact the Clerk of Court. You will be assigned a date and time to appear at the Baldwin Municipal Court. During that appearance, you may contest your citation for the non-moving traffic violation.
Failure to pay the assessed forfeiture for the violation or failure to contact the Clerk of Court within 28 business days from the date of citation issuance may result in the suspension of vehicle registration.
